A CHARTER ORDINANCE EXEMPTING THE CITY OF QUINTER, KANSAS, FROM CERTAIN PORTIONS OF K.S.A. 12-1697, K.S.A. 12-1695 AND K.S.A. 12-16,101.

BE IT ORDAINED BY THE GOVERNING BODY OF THE CITY OF QUINTER, KANSAS:

Section 1. The City of Quinter, Kansas, is a city of the third class, and by the power vested in it by article XII, Section 5, of the Constitution of the State of Kansas, hereby elects to exempt, and does exempt itself, from, and make inapplicable to it, that portion of K.S.A. 12-1 697, which authorizes the levy of a transient guest tax not to exceed the rate of 10 percent (10%) upon the gross receipts derived from or paid by transient guests for sleeping accommodations, exclusive of charges for incidental services or facilities in any hotel, motel or tourist court, 12-1695 and 12-16, 101, which establishes a ten (10) member committee, a majority of which shall be representatives of businesses coming from within the terms of this act; said statutes not being uniformly applicable to all cities in Kansas.

Section 2. In place of that portion of K.S.A. 12-1697 referred to above, the governing body of the City of Quinter, Kansas, is hereby authorized to levy a transient guest tax at not to exceed the rate of four percent (4%) upon the gross receipts derived from or paid by transient guests for sleeping accommodations, exclusive of charges for incidental services or facilities in any hotel, motel or tourist court.

Section 3. All other provisions of K.S.A. 12-1697 shall remain the same.

Section 4. In place of that portion of K.S.A. 12-1695 and K.S. A. 12-16,101 referred to above, the mayor of the City of Quinter, Kansas, shall appoint a Board of the Convention and Tourism activities which shall be composed of four (4) member who shall serve without compensation for four (4) years in staggered terms.  Two of the members shall be owners or operators of motels or hotels within the City, and the remaining members shall be residents of, or owners or operators of businesses located within the City.

The City Council shall ensure that in appointing members to said committee, at all times at least two (2) members shall be representatives of the hotel or motel industry. Any member who is absent without excuse from three (3) consecutive regular meetings shall be deemed to have resigned and a successor shall be appointed.  

Section 5. All other provisions of K.S.A. 12-1695 and K.S.A. 12-16,101 shall remain the same.
